  1. Validity of the Sales Agreement, Product and Price Information

The sales terms apply when purchasing goods from the online store.

The prices of the products sold in the online store are listed next to the products. A delivery fee may be added to the product price. The product price in the online store may differ from the price in physical stores that sell Artlab products. The product price and availability may change without notice.

  1. Order Placement

Orders can be placed in the online store as a guest (without creating an account) or by creating an online store account.

To order, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled out and the appropriate delivery method selected. The total amount to be paid will then be displayed, and the payment can be made via a bank link or other payment methods.

The agreement comes into force once the payment has been received into the online store’s settlement account.

If the ordered product cannot be delivered due to stock shortage or another reason, the Buyer will be informed as soon as possible, and the paid amount (including delivery costs) will be refunded without delay, but no later than 14 days.

  1. Delivery

Goods are shipped to the following countries: European Union countries and, by agreement with the online store, other countries.

The delivery costs are borne by the Buyer, depending on the order size and delivery method, and the corresponding price information is displayed next to the shipping method. For shipments within Estonia, delivery is free for orders over 50 €.

Domestic shipments within Estonia typically arrive at the specified destination 1-10 business days after the sales agreement comes into force. For deliveries outside of Estonia, the delivery will take place within 30 calendar days.

In exceptional cases, the goods may be delivered within up to 45 calendar days.

  1. Right of Withdrawal

After receiving the order, the Buyer has the right to withdraw from the contract made in the online store within 14 days.

The right of withdrawal does not apply if the Buyer is a legal entity.

To use the 14-day return right, the ordered goods must not be used in any other way than necessary to check the nature, features, and functionality of the goods as allowed when testing the goods in a physical store.

The right of withdrawal does not apply if the goods delivered to the Buyer are sealed items that are not suitable for return for health or hygiene reasons and have been opened after delivery.

If the goods have been used for purposes other than verifying the nature, characteristics, and functionality of the goods or show signs of use or wear, the online store has the right to reduce the refund according to the reduction in the value of the goods.

To return the goods, the Buyer must submit a withdrawal statement and send it to the email address artlabestonia@gmail.com no later than 14 days after receiving the goods.

The Buyer bears the return shipping costs, except when the return is due to the fact that the returned item does not correspond to the order (e.g., incorrect or defective item).

The Buyer must return the goods within 14 days of submitting the statement or provide proof that the goods have been handed over to the carrier during this period.

The online store will refund the amount paid for the returned goods without delay but no later than 14 days after receiving the withdrawal statement.

The online store may refuse to make refunds until the goods in question are returned or until the Buyer has provided proof that the goods have been returned, depending on which occurs earlier.

If the Buyer has explicitly chosen a delivery method other than the most affordable standard delivery method offered by the online store, the online store does not have to refund the cost exceeding that of the standard delivery method.

The online store has the right to withdraw from the sales agreement and request the return of the goods if the price of the goods in the online store has been significantly misrepresented due to a mistake.

  1. Right to Submit a Complaint

The online store is responsible for non-compliance or defects in the goods sold to the Buyer that existed at the time of transfer and appear within two years from the delivery of the goods to the Buyer. For the first six months after delivery, it is assumed that the defect existed at the time of delivery. The online store must prove otherwise. The Buyer has the right to submit a complaint within two months of noticing a defect by sending an email to artlabestonia@gmail.com or calling +372 58667027.

The online store is not responsible for defects that occur after the goods have been transferred to the Buyer.

If the goods purchased from the online store are defective, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store will refund the Buyer for all amounts paid under the sales agreement.

The online store will respond to the consumer’s complaint in writing or in another form that allows written reproduction within 15 days.

  1. Direct Marketing and Personal Data Processing

The online store uses the personal data entered by the Buyer (including name, phone number, address, email address, and bank details) only to process the order and deliver the goods to the Buyer. The online store may forward the personal data to the delivery service provider for the purpose of delivering the goods.

The online store sends newsletters and offers to the Buyer’s email address only if the Buyer has expressed consent by entering their email address on the website and agreeing to receive direct marketing messages.

The Buyer can unsubscribe from the emails at any time by notifying the online store via email or by following the instructions provided in the email containing the offers.

  1. Dispute Resolution

If the Buyer has complaints regarding the online store, they must be sent to the email address artlabestonia@gmail.com or by calling +372 58667027.

If the Buyer and the online store cannot resolve the dispute by agreement, the Buyer may turn to the Consumer Disputes Committee. The Committee has the authority to resolve disputes arising from the agreement between the Buyer and the online store. Reviewing the Buyer’s complaint by the Committee is free of charge.

The Buyer may also turn to the European Union Online Dispute Resolution platform.
